ARCOM GROUP E-COMMERCE TERMS AND CONDITIONS
These legally binding Terms and Conditions (the “Terms”) together with any other contract provided for transactions/customers constitute an agreement enforceable by law between you (the “Customer”, “You”, “Your”) and the Company (“Arcom Group”, “AG”, “we”, “us” and/or “our”) governing your access to and use of the Arcom Group website, including any subdomains thereof, and our mobile, tablet and other smart device applications, and application program interfaces and all associated services (collectively, the “Platform”).
Please read these terms and conditions carefully before using any of Our Services.
1. Definitions.
“AG Platform” AG Platform is an e-marketplace that enables Customers to purchase AG products of Tiles and Sanitary Ware as well as other E-commerce Services provided by AG on the Platform.
“Feedback” means feedback, innovations, or suggestions sent by the Customer regarding the attributes, performance, or features of our Services;
“Services” means the Services provided by AG to the Customer which consist of selling Sanitary Ware as well as Tiles, Vanities, Chimneys, Fit-outs / Spacers & Accessories, Adhesives, and Pastes.
“Order” means any order placed on the AG Platform;
“Country” means the Republic of Lebanon;
2. Acknowledgment.
These are the Terms and Conditions governing the use of the Services provided by AG and the agreement that operates between You and AG. These Terms and Conditions set out the rights and obligations of all Customers regarding the use of the Services.
Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, Customers, and others who access the AG Platform and/or use the Services.
By accessing or using the Services You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Services. You represent that You are over the age of 18. AG does not permit those under 18 to use the Services.
Your access to and use of the Services is also conditioned on Your acceptance of and compliance with the Privacy Policy of AG. Our Privacy Policy describes Our policies and procedures on the collection, use, and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. Please read Our Privacy Policy carefully before using Our Service.
3. Placing Orders for Products.
By placing an Order for Products or using any of the Services offered through the Platform, You warrant that You are legally capable of entering into binding contracts.
4. Your Information.
If You wish to place an Order for Products available on the Platform, You may be asked to supply certain information relevant to Your Order including, without limitation, Your name, Your email address, Your phone number, Your credit card number, the expiration date of Your credit card, Your billing address, and Your shipping information.
You represent and warrant that: (i) You have the legal right to use any credit or debit card(s) or another payment method (s) in connection with any Order; and that (ii) the information You supply to us is true, correct, and complete.
By submitting such information, You grant us the right to provide the information to payment processing third parties for purposes of facilitating the completion of Your Order.
5. Privacy Policy.
When You access the AG Platform, we may ask You to voluntarily provide us with certain information that personally identifies You or could be used to personally identify You. You hereby consent to the collection of such information. We will be free to use, collect and disclose information that is freely available in the public domain without Your consent.
You understand that we may use certain information of Yours (a) to provide You the services, (b) for commercial purposes and in an aggregated or non-personally identifiable form for research, statistical analysis, and business intelligence purposes, (c) for sale or transfer of such research, statistical or intelligence data in an aggregated or non-personally identifiable form to third parties and affiliates (d) for communication purpose, (e) debugging customer support related issues.
We also reserve the right to use the information provided by or about a Customer for offering new products or Services; taking product and Service feedback; analyzing software usage patterns for improving product design and utility. You provide Your consent to such collection, use, and disclosure as required under applicable laws.
You are responsible for maintaining the accuracy of the information You submit to us, such as Your contact information provided as part of registration. If Your personal information changes, You may correct, delete inaccuracies, or amend information by making the change on our member information page or by contacting us. We will make good faith efforts to apply the requested changes in our then active databases as soon as reasonably practicable.
If You wish to request that we no longer use Your information, please contact us. We will retain your information for as long as needed to provide You with the Services. We shall not retain such information for longer than is required for the purposes for which the information may lawfully be used or is otherwise required under any other law for the time being in force. After a while, Your data may be anonymized and aggregated, and then may be held by us as long as necessary for us to provide our Services effectively, but our use of the anonymized data will be solely for analytic purposes. Please note that Your withdrawal of consent to the provision of Your information may result in us being unable to provide You with Our Services or to terminate any existing relationship we may have with You.
We may collect credit card numbers and/or other financial institution information such as bank account numbers and will use that information for the billing and payment processes, including but not limited to the use and disclosure of such credit card numbers and information to third parties as necessary to complete such billing operation. Verification of credit information, however, is accomplished solely by the Customers through the authentication process. Customers’ credit- card/debit card details are transacted upon secure sites of approved payment gateways which are digitally under encryption, thereby providing the highest possible degree of care as per current technology. The Customer is advised, however, that internet technology is not foolproof safe and the Customer should exercise discretion on using the same.
Due to the communication standards on the Internet, when the Customer or the end-user, or anyone visits the AG Platform, we automatically receive the URL of the site from which anyone visits. We also receive the Internet Protocol (IP) address of each of the Customer’s computers (or the proxy server the Customer used to access the World Wide Web), the Customer’s computer operating system, and the type of web browser the Customer is using, email patterns, as well as the name of the Customer’s ISP.
We use temporary cookies to store certain information that is used by us for the technical administration, research, and development, and the Customer’s administration. In the course of serving advertisements or optimizing Services to its Customers, AG may allow authorized third parties to place or recognize a unique cookie on the Customer’s browser. The cookies, however, do not store any personal information of the Customer. You may adjust Your internet browser to disable cookies. If cookies are disabled You may still use the AG Platform, but it may be limited in the use of some of the features.
This Privacy Policy applies to all Services that are owned and operated by AG. AG does not exercise control over the sites displayed as search results or links from within its Services. These other sites may place their cookies or other files on the Customer’s computer, collect data or solicit personal information from the Customer, for which we are not responsible or liable. Accordingly, we do not make any representations concerning the privacy practices or policies of such third parties or terms of such websites, nor do we guarantee the accuracy, integrity, or quality of the information, data, text, software, sound, photographs, graphics, videos, messages or other materials available on such websites. The inclusion or exclusion does not imply any endorsement by us of the website, the website's provider, or the information on the website. If You decide to visit a third-party website linked to the AG Platform, You do this entirely at Your own risk. We encourage the Customer to read the privacy policies of that website.
We may enable the Customer to communicate with other users, whereupon other the Customer may collect such data. Such users, including any moderators or administrators, are not authorized AG representatives or agents, and their opinions or statements do not necessarily reflect those of AG, and they are not authorized to bind AG to any contract. AG hereby expressly disclaims any liability for any reliance or misuse of such information that is made available by the Customers or visitors in such a manner.
AG has implemented best international market practices and security policies, rules, and technical measures to protect the personal data that it has under its control from unauthorized access, improper use or disclosure, unauthorized modification, and unlawful destruction or accidental loss. However, for any data loss or theft due to unauthorized access to the Customer’s electronic devices through which the Customer avails the services, we shall not be held liable for any loss whatsoever incurred by the Customer.
AG implements reasonable security practices and procedures and has a comprehensively documented information security program and information security policies that contain managerial, technical, operational, and physical security control measures that are commensurate with the information being collected and the nature of AG’s business.
AG takes Your right to privacy very seriously and other than as specifically stated hereunder, will only disclose Your personal information in the event it is required to do so by law, rule, regulation, law enforcement agency, governmental official, legal authority, or similar requirements or when it, in its sole discretion, deems it necessary to protect its rights or the rights of others, to prevent harm to persons or property, to fight fraud and credit risk, or to enforce or apply the Terms.
Your personal information is maintained by us in electronic form on its equipment, and on the equipment of its employees. Such information may also be converted to physical form from time to time. We take all necessary precautions to protect Your personal information both online and offline and implement reasonable security practices and measures including certain managerial, technical, operational, and physical security control measures that are commensurate with the information being collected and the nature of our business.
No administrator at AG will know Your password. You need to protect against unauthorized access to Your password, Your computer, and Your mobile phone.
6. Intellectual property and counterfeit.
AG is the owner of the intellectual property rights and holds the rights of use on all the elements accessible on the AG site, in particular the texts, images, graphics, logos, videos, icons, and sounds. Any reproduction, representation, modification, publication, or adaptation of all or part of the elements of the AG site, whatever the means or the process used, is forbidden, except with the prior written authorization of AG.
Any unauthorized exploitation of the site or of any of the elements it contains will be considered as constituting an infringement and will be prosecuted by the relevant applicable laws.
7. Order Cancellation.
We reserve the right to refuse or cancel Your Order at any time for certain reasons including but not limited to:
● Products availability;
● Errors in the description or prices for Products;
● Errors in Your Order.
We reserve the right to refuse or cancel Your Order if fraud or an unauthorized or illegal transaction is suspected.
8. Your Order Cancellation Rights.
Any Products You purchase can only be returned or refunded by these Terms and Conditions.
Refund policy
Once You place an order on Arcom.com You are deemed to agree with our terms and conditions as well as our returns policy.

Returning an unwanted item?
Sometimes an item is just not what You had expected or You might have buyer’s remorse, it happens and we are here to take care of that for you. As long as an item is still in its original and good condition, we will accept the return however it will be, subject to the rules below.
You will need to contact us within 7 days of the item being delivered to You as per the tracking history with Your order details and items you want to refund, after which we'll provide You with instructions on how to proceed with the return.
Original Condition
It's fine to open an item’s packaging to find out its color, texture, and dimension, but please don't fit it out. If an item is returned to us damaged, scratched, or in an unsuitable condition, we won't be able to give You a refund and we may have to send it back to You (and ask You to cover the delivery costs). All items are inspected on return. To receive a full refund, all items must be returned to us unused and in the same condition You received them with their original packaging and all labels/stickers attached within 7 days from receipt.

Responsibility
Just like You would expect to receive the items safely when You order them from us, the returned items are Your responsibility until they reach us, so make sure they're packed properly and don't get damaged on the way!
As the parcel remains Your responsibility until it arrives back with us, ensure that You get proof of postage in case You need to contact us about Your return.
To sum things up
• The items should not be used.
• The Items should be packed with the original packaging received.
• Within 7 days from receipt.

Refund amount
• If you have paid shipping charges for Your order, we will refund You the cost of the items excluding the shipping cost paid which is non-refundable.
• If Your order qualified for free shipping, and the items that You are returning will drop the total value of Your order to below the free shipping threshold, we will refund You for the cost of goods returned less than $ 30 for the original shipping and restocking fee.
• Refunds will be made to the same Card/PayPal account used to place the order or as store credit.
• We are unable to provide a refund for Cash on Delivery orders, we will provide store credits that can be used on future orders.
• Items sent to the EU and Canada are sent on a DTP basis (Duties and Taxes Paid), therefore, if a customer wants to return an item, we will have to charge them back the duties and clearance fees that were prepaid on their behalf for the items which they want to return.
We aim to finish the refund process within 14 days of having received the returned item at our location.
After that?
We don't accept returns for unwanted items after the relevant return period above. If You try to make a return, we may have to send it back to Your default delivery address and ask You to cover the delivery costs.

9. Prices Policy.
AG reserves the right to revise its prices at any time before accepting an Order.
The prices quoted may be revised by AG after accepting an Order in the event of any occurrence affecting delivery caused by government action, variation in customs duties, increased shipping charges, higher foreign exchange costs, and any other matter beyond the control of AG. In that event, You will have the right to cancel Your Order.
10. Payments.
Payments can be made through various payment methods we have available, such as Visa, MasterCard, Affinity Card, American Express cards, or online payment methods (PayPal, for example).
Payment cards (credit cards or debit cards) are subject to validation checks and authorization by Your card issuer. If we do not receive the required authorization, we will not be liable for any delay or non-delivery of Your Order.
11. Your Feedback to Us.
You assign all rights, titles, and interests in any Feedback You provide to AG. If for any reason such assignment is ineffective, You agree to grant AG a non-exclusive, perpetual, irrevocable, royalty-free, worldwide right and license to use, reproduce, disclose, sub-license, distribute, modify, and exploit such Feedback without restriction.
12. Limitation of Liability.
AG disclaims all representations and warranties- expressed, implied, or statutory. To the maximum extent permissible by the applicable laws, AG will not be liable for any damages of any kind, including without limitation, direct, indirect, incidental, punitive, and consequential damages, arising out of or in connection with these Terms, the inability to use the AG Platform or the transaction processing service, or those resulting from any goods or Services purchased or obtained or messages received or transactions entered into through the AG. This limitation shall apply regardless of the form of action, whether in contract or tort, including negligence, or any other form of action, and regardless of whether AG was informed in advance.
AG shall not be liable for any interruptions in the operation of the AG Platform under the Terms due to technical interruptions in the operation of equipment, software, interruptions in the operation of communication channels, interruptions in power supply, global interruptions in the work of the local country and the international segments of the Internet, failures in routing systems and/or in the domain system names, DDoS attacks and other unlawful actions that violate the performance of Internet resources and communication channels. The Customer understands that errors and malfunctions are possible, including concerning the operation of the software/resource that ensures the operation of the AG Platform. AG shall attempt to take reasonable measures to prevent such interruptions and eliminate them within a reasonable time.
13. Indemnification.
The Customer shall promptly indemnify, defend and hold harmless AG, its affiliates, officers, directors, shareholders, employees, and agents (harmless from and against any claims, liability, damage, loss, or expense arising from (a) usage of AG Platform by the Customer; or (b) breach (or threatened breach) of any provision, representation or warranty by the Customer; (c) any act or omission relating to the Customer’s performance; and/or (d) non-compliance of any laws by the Customer.
14. Notification of incident.
Despite our best efforts, no method of transmission over the Internet and no method of electronic storage are completely secure. Therefore, we cannot guarantee absolute security. If we become aware of a security breach, we will notify the affected Customers so that they can take appropriate action. Our incident notification procedures take into account our legal obligations, whether at the national or International level. We are committed to fully informing our Customers of all matters relating to the security of their accounts and to providing them with all necessary information to help them meet their regulatory reporting obligations.
No personal information of the Customer of the AG site is published, exchanged, transferred, ceded, or sold on any medium to third parties without the Customer’s knowledge. Only the assumption of the repurchase of AG and its rights would allow the transmission of the aforementioned information to the possible Customer who would be in turn held of the same obligation of conservation and modification of the data concerning the Customer of AG’s site.
15. “AS IS” and “ AS AVAILABLE” Disclaimer.
The Services are provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, AG, on its behalf and on behalf of its Affiliates and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, concerning the Services, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of a course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, AG provides no warranty or undertaking, and makes no representation of any kind that the Services will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems, or services, operate without interruption, meet any performance or reliability standards or be error-free or that any errors or defects can or will be corrected.
Without limiting the foregoing, neither AG nor any of AG’s providers make any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Services, or the information, content, and materials or products included thereon; (ii) that the Services will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Services; or (iv) that the Services, the content, or e-mails sent from or on behalf of AG are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.
Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to You. But in such a case the exclusions and limitations outlined in this section shall be applied to the greatest extent enforceable under applicable law.
16. Governing Law.
The laws of Lebanon, excluding its conflicts of law rules, shall govern these Terms and Your use of the Services. Your use of the Application may also be subject to other local, state, national, or international laws.
17. Dispute Resolution.
If You have any concern or dispute about the Services, You agree to first try to resolve the dispute informally by contacting AG. Failure to amicably agree on a settlement, the Beirut Courts shall have exclusive jurisdictions to settle any disputes which may arise out of or in connection with the present Terms and/or the Services provided by AG.

18. Severability.
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under the applicable laws and the remaining provisions will continue in full force and effect.
19. Changes to these Terms and Conditions.
We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days’ notice before any new terms take effect. What constitutes a material change will be determined at Our sole discretion.
By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Services.
